Rakishev told the truth about the letters with minors in US court

For an extended period, there has been a controversy surrounding the personal habits of Kazakh businessman Kenes Rakishev. Kazaword has recently published an extensive collection of the businessman’s correspondences, which not only include business-related messages but also delve into his personal affairs. Of particular note is Rakishev’s communication with Peter Listerman, referred to as Pogrom No. 1. The content of these exchanges, as revealed by Rucriminal will be disclosed later. In the meantime, let’s delve into the reactions of both Rakishev and Listerman to the unfolding situation.

Listerman promptly succeeded in having video clips featuring presentations of girls intended for Rakishev removed from the internet. The explanation provided was that these videos originated from a personal archive and were not meant for public display. This move is not surprising, considering the explicit nature of the content, where girls disclose their age, adding an intriguing dimension to the situation.

Rakishev has maintained a public silence on this matter. However, his legal representatives, as revealed, are actively pursuing legal measures in various regional courts of the Russian Federation to eliminate content related to “Kenes youngsters.” They argue that the claims of underage girls corresponding with Rakishev are entirely fabricated and insist that it is a case of “fake” correspondence. They portray Rakishev as a decent family man who did not engage in communication with underage individuals.

One might consider believing this defense. However, Rucriminal has obtained the transcript of Rakishev’s interrogation in a US court during the BTA Bank lawsuit against former bank owner Mukhtar Ablyazov, Viktor Khrapunov, and Ilyas Khrapunov. Rakishev testified under oath, knowing that any falsehood could lead to imprisonment. Despite his initial reluctance, Rakishev eventually acknowledged the breach of his personal email security, covering the period from 2004 to 2014. The reluctance likely stems from the fact that, in doing so, Rakishev inadvertently confirmed the authenticity of his correspondence with Peter Listerman, also known as “pimple No. 1,” which had earlier surfaced on the network.

Now, a crucial question emerges: how does Russian legislation address the issue of engaging in sexual relations with individuals under the age of 18? This becomes particularly pertinent considering the timeline and circumstances surrounding Kenes Rakishev’s case. The unfolding events will determine whether time will bring consequences for Kenes Rakishev.

An examination of the correspondence reveals the initiation of cooperation in 2007 when Peter Listerman’s assistant sent Rakishev photographs of two individuals, specifying that one was intended for Kenes himself and the other for someone referred to as “the elder.” This reference could potentially allude to Timur Kulibayev, the son-in-law of Nazarbayev, with whom Rakishev maintains a close association. The individuals identified in this exchange were 18-year-old Dasha Konovalova and Alina Garayeva.

In 2012, the situation takes an intriguing turn. On July 11, Listerman sends Rakishev a letter concerning “Elenu S.,” accompanied by a video featuring only 15-year-old Elena Selezneva. In the recording, the girl engages in various activities, and her age is distinctly audible. Surprisingly, Rakishev appears unfazed by the minor’s age, promptly responding to Listerman with enthusiasm, stating, “Super! Skolko?” Instead of a direct answer, the oligarch receives another video, this time showcasing 21-year-old Matilda Romanova and 17-year-old Alina Marasik — both underage girls. Despite their status as minors, Rakishev casually refers to them as “super variants.”

Subsequently, in July 2013, Listerman writes again, this time sending a video of a particular model aspiring to work in films under the name “Avatar”, associated with James Kemerona. Rakishev responds promptly, saying, “Give her to Kazakhstan!” without much deliberation. Following this, Listerman sends another video featuring a dancing girl who requests $100,000 for a three-day engagement.

The subsequent exchange concludes with a letter from Rakishev stating, “Let’s reconnect after Ramadan, post-August 8th!” It’s noteworthy that Kenes Rakishev, being a Muslim, refrains from engaging in activities considered sinful during the holy month. Even images from his pilgrimage to Mecca during Hajj have been featured in the press. In contrast, Listerman, not sharing the same religious convictions as the oligarch, remarks that “such opportunities come once a year.” Rakishev agrees and urges Listerman to send the girl to Kazakhstan “this week.” Listerman persists in sending letters featuring photographs of the girls he refers to as “translators,” extending into the year 2014. Evidently, the seller and the customer have established an additional communication channel, exclusively exchanging photos and videos via mail.

Now, Rucriminal has released a printout of Rakishev’s testimony in a US court regarding the alleged “fake” correspondence.

Question: Mr. Rakishev, has BTA Bank never been a victim of hacking email?

MISTER. SCHWARTZ: Objection.

Rakishev (R). I’m not sure I can answer this question. I really do not understand what that means. Maybe hackers could answer this question better than I do.

Q. At the moment, I’m not asking you to provide any details about the hacking. This is a simple question, do you know that BTA mail was hacked?

R. I’m not sure I can answer this question, because I’m not an expert in IT matters.

Q. And have your personal letters ever been hacked?R. I believe I can say-yes. More precisely, by my personal e-mail, I can not say that it was hacked. I just lost access to my email, which I used from 2004 to 2014.

Q. Did the contents of your letters ever appear in places beyond your control?

MISTER. SCHWARTZ: Objection.

R. Can I clarify? Are you asking this question in this particular case? Because in my personal letters, there was nothing relevant to this matter.

Question: Maybe. I’ll ask more broadly. Have your personal letters ever been stolen?

R. I want to repeat again, starting in 2014, I did not have access to my personal, not corporate, email address

Q. Mr. Rakishev, have you ever heard of the Kazaword website?

Rakishev (R): Yes, I heard.

Q. BTA Bank and you took the position that Ilyas Khrapunov is responsible for hacking an email that appeared on Kazaword?

MISTER. SCHWARTZ: Objection.

R. In fact, you answer your own question.

Question: Mr. Rakishev, my question is this. Do you know that the lawyers of the bank in which you are chairman of the council took a position in the US Federal Court that Ilyas Khrapuny is responsible for the theft of letters that appeared on Kazaword?

MISTER. SCHWARTZ: Objection.

R. Actually, different lawyers have different theories in relation to this issue. I believe that the court will be able to answer this question.

Q. Let me say. I do not want to know what your lawyers told you privately. I want to warn you not to go this route. Do you believe Mr. Rakishev that Mr. Khrapunov is responsible for hacking an email that appeared on Kazaword?

MISTER. SCHWARTZ: Objection. This is so important, what does he think about this?

MISTER. Curly: He can just answer the question I asked three minutes ago and we’ll go through this.

R. Counselor, can I ask a question? How relevant is this issue to the proceedings that are taking place now?

Q. Let me state it differently. Have you ever discussed hacking email with Mr. Nurgabylov?

MISTER. SCHWARTZ: Objection.

R. With many people I discussed the fact that I did not have access to my personal email account. This happened in 2014. And I can argue that in my own email there have never been emails that have been sent to me or me, about this particular case. That’s why, if we discuss my personal email account, I must say that this has nothing to do with this particular issue.

Q. So you say that your personal email account contains messages that you did not send, is that correct?

MISTER. SCHWARTZ: No

R. No, I did not say that. I said that since 2014, I did not have access to my personal email

R. There are many people in Kazakhstan who are discussing this site.

Q. Mr. Rakishev, do you have any evidence that Mr. Ilyas Khrapunov is responsible for hacking an email that appeared on Kazaword?

R. I would like to repeat, if this situation had even the slightest relation to this particular case, I would be ready to discuss this with you.

Kazakhstan: Anti-corruption Sanctions

I thank Mr Speaker for granting this debate and the Minister for joining us. I also thank a host of civil society experts who have helped me — too many to name — but I give special thanks to Professor John Heathershaw of Exeter University, Adam Hug of the Foreign Policy Centre and Sue Hawley of Spotlight on Corruption.

Earlier this week, the Foreign Secretary announced welcome moves to toughen up the sanctions regime against Russia, but we should not be waiting for a potential military crisis before we act against illicit finance at home and corruption overseas. We should act and use the powers we have now.

Today, I want to shine a light on foreign corruption in another state, not simply because that is important in itself, but because I want to highlight the UK’s role in facilitating shameful wrongdoing. Put simply, Britain enables kleptocracy. My ask of the Government is twofold. First, they should act proactively by sanctioning wrongdoers in Kazakhstan. Secondly, now that they have committed to tabling an economic crime Bill in the next Session, they must ensure the Bill’s provisions are fit for purpose, tough, effective and appropriate so that Britain can show by what we do that we are seriously committed to fighting the scourge of dirty money.

It is 30 years since Kazakhstan, a multi-ethnic, resource-rich central Asian state, emerged from the disintegration of the Soviet Union. In those years, Kazakhstan has, by some indicators, been a success. Its GDP growth has outstripped that of many of its neighbours, including Russia. Living standards are higher and until the 2010s Kazakhstan appeared to enjoy political stability.  

But there is another side to the Kazakhstan story. The country is ruled by a kleptocratic elite that has grown rich off the back of money stolen from its people. Until 2019, its autocratic dictator was Nursultan Nazarbayev.  In Kazakhstan, just 162 people own 55% of the wealth — mostly members of Nazarbayev’s family or close associates. The country has a poor human rights record and little media freedom.  

As early as 2006, Jonathan Winer, former Deputy Assistant Secretary of State for International Law Enforcement in the Clinton Administration, said:

“I can’t think of a leader in the free world as notoriously corrupt as Nazarbayev… We’ve know about his corruption for at least 15 years”.  

 Yet in Britain, we turned a blind eye, ignored the corruption and helped the Kazakh regime launder and spend its dirty money. 

Three examples confirm my view. Between 2008 and 2015, we issued 205 Kazakh kleptocrats with golden visas to settle with their dirty money in the UK, which was the fifth most common country for users of the Tier 1 Investor scheme. A recent Chatham House report reveals that the Kazakh elite owns over half a billion pounds of property in the UK. Around £330 million of that belongs to Nazarbayev’s extended family, including Sunninghill Park, allegedly bought by Nazarbayev’s son-in-law for £15 million — £3 million over the asking price. The Organised Crime and Corruption Reporting Project has revealed how Nazarbayev secretly controls four charitable foundations with at least $7.8 billion-worth of assets, invested in everything from hotels to banks. This global fortune is part-owned through a UK listed holding company set up in 2020 — Jusan Technologies. 

We have opened our borders, our property market and our financial structures to the Kazakh ruling class, enabling them to launder their illicit wealth and spend it. Worse, we do not even enforce our existing laws against any of this wrongdoing. 

Why does this matter now? Because the fault lines of the corrupt Kazakh political elite have exploded. Protests, initially triggered by the soaring costs of liquidised petroleum gas, quickly developed into a national movement against the governing regime. The response from the new President, Tokayev, allegedly handpicked for the job by Nazarbayev, was initially to distance himself from the old regime. He then requested support from Russia, which sent in troops. Finally, on 7 January, he deployed the military against the protesters, with a “shoot to kill without warning” order. Protesters, most of whom were peaceful citizens, were gunned down without so much as a warning shot. According to some experts, this shocking, violent suppression has left 225 dead, 4,500 injured and 10,000 arrested.  

That terrible loss of life in Kazakhstan should lead to a moment of reflection for us in Britain. We are complicit in what is happening in Kazakhstan. Our lack of transparency over foreign property ownership, our lax regulatory regime and our weak enforcement agencies have all aided and abetted the Kazakh elite. 

Yet it is not too late for us to act. The Government have put in place a new regime of anti-corruption sanctions to complement our Magnitsky sanctions. They allow us to designate foreign, corrupt actors, freeze their UK assets, stop them entering Britain and limit their access to our financial or legal enablers. Sanctions are powerful tools, but, Minister, they must be used. That is why the Government should impose sanctions on the Kazakh oligarchs, who have systematically robbed their people to line their own pockets. The recent violence demonstrates the true cost of kleptocracy. It is surely up to us, in the UK, the jurisdiction that has done so much to facilitate corruption in Kazakhstan, to act and hold these individuals to account.  

Our all-party group on anti-corruption and responsible tax is co-operating with representatives from legislatures in Europe and America. We have formed the Inter-Parliamentary Alliance against Kleptocracy, and together we are urging Governments in the UK, the US and the EU to issue sanctions against the kleptocrats of Kazakhstan. Today, I am calling for action from the UK to designate anti-corruption sanctions against the following individuals, whom I shall name, all of whom are allegedly involved in asset seizure and bribery. The details I will provide are limited because of time, but every story is shocking.

There is Timur Kulibayev, his wife Dinаra Nazarbayeva — the daughter of Nazarbayev — and their associate Arvind Tiku. Evidence suggests that Kulibayev abused his position to accrue vast wealth. In 2020, the Financial Times showed that Kulibayev benefited from a secret scheme to divert profits from big state pipeline contracts. He has faced money laundering and bribery investigations in other jurisdictions. His worth, according to Forbes, is $2.9 billion, and he owns at least £60 million of real estate here in the UK.

There is Dariga Nazarbayeva and her rumoured husband Kairat Sharipbayev. Dariga is Nazarbayev’s eldest daughter. Her empire, estimated by Forbes at $595 million, is hidden in an incredibly complex system of offshore companies, foundations and trusts. Three of her London properties were subject to a failed unexplained wealth order, but investigators at Source Material allege that Nazarbayeva may have misled the UK High Court. Meanwhile, Sharipbayev is allegedly one of the beneficiaries of a $334 million fraud at Kazakh bank Bank RBK, which has been labelled

“the bank of the Nazarbayev family”.

There is Nurali Aliyev, son of Dariga and grandson of the former ruler. Aliyev was appointed deputy chairman of a private Kazakh bank called Nurbank — after the grandfather — at the age of 21, and chairman at 22. UK court documents show he received a $65 million loan from a bank in 2008, through a company which then made a further loan. According to Nurali’s lawyers, he used some of those funds to purchase a £39.5 million house in Bishops Avenue.

There is Karim Massimov, and his associate Aigul Nuriyeva. Massimov is a former Prime Minister of Kazakhstan who has been subject to bribery allegations, including from UK listed companies, as reported in the FT. He was also implicated in allegations of bribery by Airbus for the purchase of 45 helicopters. Nuriyeva is a Kazakh banker and alleged proxy for Massimov, who is himself implicated in major bribery scandals totalling $64 million with the Swedish telecoms company Teli.

Vladimir Kim is Kazakhstan’s richest man, worth some $4.3 billion. He chaired Kazakhmys plc, the first Kazakh company to list on the London Stock Exchange. A Global Witness report claimed that Kim acted as a proxy owner, and that Nazarbayev actually controlled the company. In 2017, Kim’s daughter Kamila, then 18, bought three flats worth $60 million in Knightsbridge. His associate, Eduard Ogay, is co-owner of Kazakhmys — sorry if I am pronouncing these names wrongly — and is alleged to have given bribes to the country’s Prime Minister.

Kenes Rakishev is a mysteriously wealthy Kazakh businessman worth up to $1.6 billion, with close ties to the political elite, and a close associate of the head of the Chechen Republic, who has been sanctioned by the US.

Sauat Mynbayev was Minister for energy and mineral resources, yet he secretly co-owned a Bermuda-based company worth $3 billion, which won public contracts in Kazakhstan despite the obvious conflicts of interest with his ministerial role. His wife and son own property in the UK.

Alexander Mashkevich, Patokh Chodiev and an associate who died were known as the “Trio”, renowned for their ownership of Eurasian Natural Resources Corporation, a Kazakh-based mining company also listed on the London Stock Exchange. In 2013, the Serious Fraud Office launched a criminal investigation into the company, following allegations of bribery to African political figures.

Bulat Utemuratov is a former chief of staff to Nazarbayev. A US diplomatic cable reported allegations that Utemuratov was the President’s “personal financial manager” and his own website assesses his personal wealth at $3.9 billion.

Bolat Nazarbayev is Nursultan Nazarbayev’s very wealthy brother. In 2008, he purchased a £20 million apartment in Manhattan’s ultra-exclusive Plaza Hotel. He is accused of involvement in armed groups that helped to spark the January violence.

Akhmetzhan Yesimov, chairman of the sovereign wealth fund, allegedly abused his position to give his former son-in-law, Galimzhan Yessenov, related party loans through secretive British Virgin Islands companies to buy a UK entity called Kazphosphate. Yessenov is now one of Kazakhstan’s richest men.

Kairat Boranbayev’s daughter married Nazarbayev’s grandson — it is all in the family. He held a number of positions, including one involved in the notoriously corrupt transit of gas from Turkmenistan. He owns a £25.4 million mansion in an exclusive gated community in Virginia Water, a £60 million flat in One Hyde Park, and three luxury apartments, worth more than £15 million, in Knightsbridge.

Then there is Alexander Klebanov and his son Yakov. Alexander has an estimated wealth of $374 million and chairs the Central Asian Electric Power Corporation. The two act as financial proxies for the former president’s family, and are thought to have helped Dariga Nazarbayeva to avoid the unexplained wealth order.

Nurlan Nigmatulin, Baurzhan Baibek and Marat Beketayev are senior figures in the ruling Nur Otan party and are close associates of Nazarbayev. They are embedded in supporting corruption and allegedly responsible for human rights abuses.

A UK High Court has highlighted how Aliya Nazarbayeva, Nazarbayev’s youngest daughter, moved over $300 million out of the country through complex offshore structures, including in the BVI. Aidan Karibzhanov is accused by his former wife of having profited from his position as a banker by selling the Kazakhstan national telecoms company and, I quote,

“privatization of public assets resulting in huge profits to politically connected insiders at the expense of the state”.

Kairat Satybaldy and Samat Abish are Nazarbayev’s nephews, enjoying significant wealth through offshore structures. Both are key players in Nazarbayev’s inner circle, involved in the current power struggle that is undermining peace and security.

I have named those people. Imposing sanctions on this corrupt elite will not of itself root out evil practices or lead to a radical democratic transformation in Kazakhstan, but it will demonstrate that we mean what we say when we commit to fighting dirty money and corruption. The cost of inaction is high. The reputation of London and our financial services sector is already sullied, with the UK seen as the jurisdiction of choice for dirty money. With swift action, we can begin to restore the idea of a good global Britain and demonstrate to our allies that we will not provide a safe haven for kleptocrats or oligarchs.

I ask the Minister whether he will consider the individuals I have named and impose sanctions on those who have stolen from their country, laundered their money here, used UK structures to hide their ill-gotten gains, used the golden visa route to gain entry to the UK or committed human rights abuses. Will he act now? Only by strengthening transparency, legislating for tougher regulations and ensuring consistent, strong enforcement will we be able to hold our heads up high again as a trusted jurisdiction that lives by the highest standards. We must finally turn the warm words of successive Governments into firm actions in the promised economic crime Bill. Will the Minister confirm that the Bill will be considered this year? If the Government fail yet again on these two fronts, the only ones who will be delighted are people such as the criminal kleptocrats from Kazakhstan who will be laughing all the way to the bank.

Shakro Case: Who Could Be Hindered by the Found Dead Former Investigator Maximenko

Who Benefits from the Death of Mikhail Maksimenko?

Shocking news – former head of the main Investigative Committee of Russia (ICR) Mikhail Maksimenko was found dead in prison. He was serving time in a high-profile corruption case related to bribes for the release from arrest and termination of criminal prosecution of one of the closest associates of the influential thief in law Zakhar Kalashov (Shakro Molodoy) – Andrey Kochuykov (Italian).

Maksimenko’s story is full of oddities and interesting facts that, when connected together, may suggest that what happened to the former operative was not accidental.

The shootout ended up in the pre-trial detention center

Sources claim that Maksimenko did not have the right to parole. However, he might have known a lot that could hinder several high-ranking individuals.

Recall, it all started with a shootout – at the Elements restaurant on Rochdelskaya Street, when Kochuykov and his “brothers” came to the owner of the establishment, Zhanna Kim, to force her to pay an alleged debt of 8 million rubles to the designer Fatima Misikova, a friend of Shakro. Zhanna Kim is also linked online to businessman from Kazakhstan Kenes Rakishev.

The negotiations, it seems, did not go well and escalated into a gunfight. Two people from Kochuykov’s side were taken down by Eduard Budantsev, a former KGB and MVD officer, who sided with Ms. Kim.

In the subsequent investigation, the case involved State Duma deputy Andrei Skoch (a partner of oligarch Alisher Usmanov), whose role in the entire affair remains officially obscure.

However, as claimed by the authors of the Telegram channel “Futlyar ot violoncheli,” allegedly “Shakro Molodoy, considering that Budantsev was provided by Andrey Skoch, a State Duma deputy, to assist Rakishev, confronted him and his partner, another well-known oligarch, with offensive accusations: why did they send ‘feathered’ (in criminal jargon – law enforcement representatives) to settle the dispute.” What business could Skoch have with Rakishev?

In the end, Kochuykov was arrested, and the investigators, including Maksimenko, who failed to ‘extract’ him, were eventually sent to prison on the initiative of the FSB.

The Dark “Knight”

Over time, Yuri Chaika, the influential Prosecutor General of that period, was replaced by Igor Krasnov, and previously “secret” information began to surface. Rumor has it that it was challenging for the patrons of the aforementioned individuals. According to the authors of the Telegram channel “Футляр от виолончели” (“Cello Case”), one of the key decision-makers was supposedly Valery Bitaev – an extremely discreet figure referred to on the internet as the “chief negotiator between major businesses, powerful criminal groups, and law enforcement of all kinds.”

Valery Bitaev is a co-owner of “Letona Jet” LLC, which is involved in nothing less than the leasing of aircraft and aviation equipment. Earlier, he was also a co-owner of the “Citadel” holding, bringing together companies operating in the field of information security. Currently, information about this is only preserved in the media. Former head of the “K” department of the Ministry of Internal Affairs, Boris Miroshnikov, who is widely known for his conflict with the founder of “Euroset” Evgeny Chichvarkin (recognized as a foreign agent on the territory of the Russian Federation), worked there. The latter accused the general of attacking “Euroset,” leading to him being forced to sell his stake.

Among those allegedly benefiting from Mr. Bitaev’s services in the “issue resolution” sphere, prominent names are mentioned, including the name of Andrei Skoch.

It is known that the latter filed lawsuits against several media outlets that linked him to the case of Shakro Young. As for Bitaev, despite the vast amount of compromising material on dubious websites, there is hardly any official information – even about what he was involved in during the 90s, which raises suspicions. Could there be some quasi-criminal affairs “blurred” in Bitaev’s biography? Considering the attributed abilities and connections, we do not rule out such a possibility.

Mr. Maksimenko did not have the right to parole, but that doesn’t mean he didn’t want to be released. There are speculations that pressure may have been applied to him through Krasnov to make him reveal what he knows. And he might know a lot, including information about our protagonists.

The Shadow of Usmanov

Among other things, he may be well-acquainted with Alisher Usmanov, the owner of the USM Holding and Skoch’s partner. He holds the position of an advisor to the CEO of USM Holding. Additionally, the main owner of “Citadel” was Anton Cherepennikov, Usmanov’s partner in esports. Virtus.pro, founded by Cherepennikov, received a $100 million investment from USM.

In 2020, journalist Alexander Shvarev from “Rosbalt” was declared wanted, accused of libel and extortion. Kenes Rakishev and Alisher Usmanov were reportedly the victims. As claimed by the authors of the Telegram channel “Cello Case,” supposedly “the case was initiated on December 19, 2018, by the Main Directorate of the Ministry of Internal Affairs of Russia in Moscow upon the statement of businessmen’s lawyers (referring to Usmanov – ed.), who believed that Shvarev was involved in publications about the thief-in-law Zakhar Kalashov (Shakro Young), in which his name was mentioned.

Shvarev himself published material on this topic, explicitly stating in his articles that he received threats from Bitaev due to the publications, linking him to Usmanov and Skoch. What do these high-ranking gentlemen fear? Could it be that they might end up under the scrutiny of law enforcement agencies?

What does the former head of “Rosseti” Pavel Livinsky, have to do with this?

In addition to what has been described, there were rumors that, due to his professional activities, Maksimenko was involved in the “development” of the former head of “Rosseti,” Pavel Livinsky. Supposedly, a similar situation was handled from a different perspective by the infamous “billionaire colonel” Dmitry Zakharchenko, who ended up with a 16-year sentence on charges of bribery.

It was said that the former was supposed to “cover up” possible embezzlements in the United Energy Company, which was led by Livinsky, while Zakharchenko, on the contrary, was trying to curry favor.

If Mr. Maksimenko was indeed connected to all the aforementioned stories, he could have been a hindrance to several individuals. It’s not uncommon for “fixers” to receive relatively short sentences, leaving everyone satisfied. In this situation, Mr. Maksimenko was sentenced “far and for a long time,” and the assistance he might have expected never came. It’s possible that a bribe-taker accustomed to “resolving” matters decided to take matters into his own hands, for which he paid the price.

How Nursultan Nazarbayev’s “purse”, Kenes Rakishev, stole 414 million dollars from Kazakhstan

Materials for initiating a case against the oligarch are on Tokayev’s desk.

A video featuring the former mayor of Almaty, Bauyrzhan Baibek, and his family has been posted on social media from the Cyprus side of the island, from its Turkish part. Alongside Baibek, four of his younger children, his wife, and mother are reported to be traveling, according to the “Base” YouTube channel.

“Presumably, Baibek is currently in hiding. Criminal cases filed against the former mayor of Almaty on charges of embezzlement on an especially large scale are on Tokayev’s desk. A final decision on Baibek, as well as on the oligarchs Kenes Rakishev and Rahimbaev Tokayev, has not yet been made,” reports the YouTube channel.

Kenes Rakishev is known as “Nazarbayev’s wallet.” How this wallet is replenished is detailed in the investigation by Rucriminal.

In recent years, Kenes Rakishev has been leading efforts to recover assets of BTA Bank, targeting its former chairman and owner, Mukhtar Ablyazov. Rakishev has faced serious criticism, considering the meager compensations the bank managed to obtain and the colossal legal and investigative costs associated with the process. Critics have pointed out the inefficiency of the strategy chosen by BTA Bank under Rakishev’s leadership.

The investigation revealed that, while Rakishev was leading unsuccessful attempts to recover assets, he himself was also engaging in secret dealings with BTA Bank, which enriched him personally and caused significant losses to the bank. These transactions involved related parties, including the sale of Rakishev’s troubled personal assets to the bank at inflated prices, as well as the provision and write-off of bank loans. Rakishev’s hypocrisy is evident, as he not only failed to achieve the goal of recovering stolen funds but also misappropriated at least $414 million from BTA Bank for himself.

Rakishev’s actions are tantamount to fraud against BTA Bank. There were no substantial commercial reasons for BTA Bank to engage in transactions with Rakishev’s companies, and the sole purpose of these deals was Rakishev’s personal gain, shifting various losses he incurred from his personal investments onto BTA Bank.

Analysis

The conclusions above are based on the analysis of the transfer of ownership of the following two companies from Rakishev to BTA Bank:

(i) Novatus Holding Pte Ltd (“Novatus”), based in Singapore; and

(ii) Romaltyn Ltd (“Romaltyn”), based in the Isle of Man.

Novatus was registered in May 2012 and was wholly owned by Rakishev at that time. It was used by him as an investment holding company for various personal business ventures, including the establishment of the Singapore-based direct investment fund Singulariteam LP Pte (“Singulariteam”), which primarily invested in technology startups in Israel. Rakishev’s business partner in this venture is Israeli entrepreneur Moshe Hogeg, who has been arrested on suspicion of fraud, misleading investors, and human trafficking for sexual exploitation.

Novatus was also used to acquire and hold Rakishev’s stake in Net Element, a NASDAQ-listed Special Purpose Acquisition Company (SPAC). Reportedly, during Rakishev’s involvement with Net Element, the company lost almost all of its value, and Rakishev has since divested from the investments.

Additionally, Novatus was used by Rakishev to execute a bank transfer of $142,000 to Hunter Biden’s business partner, a transaction that raised suspicions in a US Senate report on alleged suspicious activity.

In 2017, Rakishev sold Novatus to BTA Bank. BTA Bank had no substantial commercial reasons to acquire Novatus, as its activities were unrelated to the core business of BTA Bank.

The sale of Novatus was organized to conceal the fact that Rakishev, the owner of BTA Bank, was selling the company to the bank. This was achieved by using a third party as a corporate intermediary in the deal to prevent Rakishev from being identified as the seller. The company used for this purpose was TZVLManagement Ltd, based in the UK. Its ultimate beneficiary is Dan Chernavsky, a lawyer and tax consultant with a questionable reputation, closely associated with Gennadiy Bogolyubov and Igor Kolomoisky, former owners of the Ukrainian Privatbank. Bogolyubov and Kolomoisky are under investigation in the US for money laundering, and the latter has also been sanctioned by the US government for his actions against the Central Bank of Ukraine.

Over one month, from May 3, 2017, to June 5, 2017, Novatus was transferred from Rakishev to TZVLManagement and then to Sterling Trustees Limited, based in the British Virgin Islands. Sterling Trustees held Novatus shares on behalf of BTA Bank until June 14, 2018, after which the bank became the direct shareholder of the company. Due to the short duration of time during which TZVLManagement owned Novatus (one month), it is evident that Rakishev engaged this company to avoid a direct sale of his personal asset to BTA Bank, which could be considered a related-party transaction.

Information about the price at which Rakishev sold Novatus is contained in the 2017 report of TZVLManagement, mentioning investments totaling $340 million. Considering the company’s previous history, it is reasonable to assume that this entire amount consisted of the purchase of Novatus shares, thus yielding Rakishev a net financial gain of $340 million.

Immediately after Rakishev’s sale of Novatus, the company started to decline in value. BTA Bank’s financial statements for 2018 show that after acquiring Novatus shares, the bank recorded a loss on this investment of approximately 14.5 billion Kazakhstani tenge (approximately $43 million USD at the exchange rate in June 2017). Novatus’s poor performance was also reflected in BTA’s 2019 report, stating that “in December 2019, all ordinary shares were fully impaired and transferred.” In other words, two and a half years after Rakishev’s sale, BTA Bank wrote off the entire value of Novatus, resulting in a loss of $340 million.

The second company sold by Rakishev to BTA Bank was Romaltyn. This Isle of Man-based company was created in 2006 as a joint venture between Kazakhgold and British Oxus Gold to participate in a tender for the purchase of a gold mine in Romania. Ownership of the company later transferred to Polyus Gold.

Rakishev acquired Romaltyn in April 2012 for $20 million, using the British Virgin Islands company Mark Global Corporation. In 2013, Rakishev transferred 49% of Romaltyn’s shares to former Prime Minister of Moldova Ion Sturza. Sturza’s stake in Romaltyn was acquired through the Seychelles-based company Millennium International Resources Corporation Ltd. Sturza remained a shareholder in Romaltyn until November 2016, after which all ownership rights reverted to Rakishev.

In January 2018, BTA Bank acquired 100% of Romaltyn as a “debt repayment from the borrower.” This indicates that the borrower, likely the company Romaltyn or its parent company controlled by Rakishev, received a loan from BTA Bank secured by Romaltyn’s shares, and the principal amount of the loan was not repaid to the creditor BTA Bank, which, in turn, accepted the entire block of Romaltyn shares.

According to an independent valuation referenced in BTA Bank’s annual report, the value of Romaltyn’s investments was 23,949,000,000 tenge, approximately $74 million USD at the exchange rate at that time. This suggests that the credit provided by BTA Bank to the borrower should have been equal to or exceeded this amount.

After its transfer to BTA Bank, the value of Romaltyn quickly depreciated. As of December 31, 2018, BTA Bank recognized an impairment of Romaltyn assets amounting to 14,400,000,000 tenge (60% of the previously assessed value in the same year). By December 2020, the investments in Romaltyn were fully impaired, according to an independent report prepared in April 2021.

Thus, the sale of Romaltyn allowed Rakishev to transfer a non-promising asset to BTA Bank, shifting a loss of at least 23.9 billion tenge ($74 million USD) onto the bank.

Novatus and Romaltyn were Rakishev’s personal investments. Novatus served as a means for private investments, primarily in information technology, while Romaltyn owned a gold mine in Romania. BTA Bank had no substantial commercial reasons to acquire either company. However, between 2017 and 2018, the bank acquired Novatus for $340 million and exchanged a loan of $74 million for the entire block of Romaltyn shares. Over two years, both companies were fully impaired, resulting in a cumulative loss of $414 million for BTA Bank.

Rakishev played in the “unknown”

On the court in the US, his memory began to fail

Rucriminal continues its series of articles on the American testimony of Kazakh oligarch Kenes Rakishev. These statements were made by Rakishev during the U.S. court proceedings, where BTA Bank’s lawsuit against the former bank owner Mukhtar Ablyazov, former head of Kazakhstan’s capital Viktor Khrapunov, and his son Ilyas Khrapunov was being examined. The legal team representing the Khrapunovs aimed to argue that Rakishev was merely a nominal owner of BTA Bank, asserting that the actual control of the bank rested with influential figures at the “top” of Kazakhstan. These individuals were alleged to be orchestrating the persecution of Ablyazov and the Khrapunovs. Rakishev disclosed the names of these high-ranking figures with whom he personally interacts, including Karim Masimov, the head of the KNB; Timur Kulibayev, the son-in-law of Kazakhstan’s leader; and Nursultan Nazarbayev himself. All these names were documented in Rakishev’s interrogation records, a certified copy of which is in possession of Rucriminal. According to Rucriminal, these suspicions were substantiated during the hearings. When questioned about specific activities of BTA Bank during his tenure as chairman of the board of directors, Rakishev responded with statements such as “I do not know,” “I was not informed,” and “Ask the bank’s lawyers.” Furthermore, when asked about his thoughts on the economy of a particular company whose fate was discussed the previous day, Rakishev candidly admitted, “I do not understand and do not have any opinions.”

The son-in-law of Nazarbayev bought a mansion, Sunninghill Park, for Prince Andrew’s mistress

New mysterious details are emerging about the sale of the mansion that once belonged to the royal family of England. On paper, everything appeared to be a fairly transparent transaction: Sunninghill Park, the former family nest of Prince Andrew, was sold for £15 million to an offshore company. However, the new owner turned out to be a subject of Kazakhstan — a wealthy Central Asian state with abundant oil and gas resources, where things are usually more complex than they seem at first glance.

While Andrew and his wife, Duchess of York, Sarah Ferguson, lived in the estate, it was called South York—transformed from Southfork (the residence of the Texan Ewing oil dynasty in the TV series “Dallas”). During the investigation into the circumstances of this deal, it was revealed that some of its participants rival the power, splendor, and affability of characters from this soap opera.

In May, The Sunday Times reported that the foreign buyer overpaid £3 million compared to the catalog price of the estate, even though there were no other interested buyers, and the property had been unsold for five years.

Now it turns out that the Kazakh individual on whose behalf the deal for the purchase of Sunninghill Park was conducted may not be the true owner of the property. Within less than a year from the signing of the contract, the estate was completely neglected and left semi-abandoned with unlocked doors. At the time of the transaction last year, close relatives of the person who bought the house were under investigation on suspicion of money laundering.

No doubt exists that the true buyer of Sunninghill Park is personally acquainted with Andrew, who has both personal and business connections in Kazakhstan. The buyer has visited the country multiple times for business trips as a special envoy, dealing with foreign trade issues. Additionally, Andrew has visited Kazakhstan privately, attempting to keep a low profile on such occasions. During a recent visit in May, he purportedly spent the weekend engaging in goose hunting with Kazakhstan’s President Nursultan Nazarbayev.

Prince Andrew’s spokesperson stated that the sale of Sunninghill Park is a private matter since state funds were not utilized for the transaction. However, as a public figure holding the position of Duke of York (last year, he received £436,000 from the public purse to cover expenses related to his duties), transparency in all his business dealings is expected for public scrutiny.

The Sunday Times uncovered that the buyer is the successful 29-year-old Kazakh businessman, Kenes Rakishev. An informed source revealed that Rakishev orchestrated the deal with the assistance of his father-in-law, the Akim (mayor) of Astana (the capital of Kazakhstan), Imangali Tasmagambetov. Andrew, familiar with both Rakishev and Tasmagambetov, declined to comment on the owner of his former home, a gift from the Queen on the occasion of his marriage to Ferguson.

Both Kazakhs claim not to be the ultimate owners of Sunninghill Park. Rakishev confirmed negotiating with Andrew about the purchase but refused to disclose the true “owner.” However, two more prominent figures in the Kazakh social scene, with whom Andrew allegedly has closer ties than with Rakishev and his father-in-law, are said to be involved in this infamous deal.

It is rumored that the 28-year-old Kazakh businesswoman, Gaukhar “Goga” Ashkenazi (pictured on the left), often seen with Andrew, has told her friends that she is the owner of Sunninghill Park. She purportedly also mentioned plans to demolish the building and replace it with something else.

A request for construction work has not been submitted yet, but over the past weekend, Ashkenazi’s spokesperson denied any involvement of her boss in the Sunninghill Park deal. Last year, Ashkenazi acquired a £27.5 million house in Holland Park, West London.

Another candidate for the role of Sunninghill Park owner is among the most powerful individuals in Kazakhstan. The 41-year-old billionaire Timur Kulibaev, an oil and gas tycoon and a frequent hunting companion of Andrew, who participates in hunts organized by Nazarbayev. If sources are to be believed, Kulibaev, who is married to Nazarbayev’s daughter Dinara, allegedly had a romantic involvement with Goga Ashkenazi. She claimed that Kulibaev is the father of her child born in December last year at the Portland Hospital in Central London.

Could it be that Kulibaev purchased Sunninghill Park? Perhaps it was a gift for the mistress who shares such a close friendship with Andrew that he introduced her to the Queen at last year’s Royal Ascot. Kulibaev’s involvement in the Sunninghill Park deal is carefully concealed. However, it is known that the Crown Estate, managing the Great Windsor Park (where Sunninghill Park is located), attempted to send a hefty water bill to a certain Olga Aristova, who works for Kulibaev in Kazakhstan.

Rakishev mentioned that Aristova serves as a manager for the billionaire. When contacted, she declined to comment. At the same time, a debt collection agency, used by E.ON, is demanding over £4,000 from Rakishev for electricity bills, also related to Sunninghill Park.

Rakishev, who calls Andrew his “friend,” firmly asserts that he has no financial connection to Sunninghill Park. When asked about the true owner, considering his involvement in the deal, Rakishev, whose conglomerate Sat&Co is reportedly partially owned by Kulibaev, responded, “If you need an answer to that question, it’s better to call Kulibaev.”

Kulibaev holds a much higher position in society than Rakishev. A Kazakh politician mentioned that Rakishev is “on errands” for Kulibaev. Although formally no longer affiliated with KazMunayGas (KMG), the state oil and gas company where he was the Vice President, Kulibaev, now the Chairman of KazEnergy (the industry’s main organization), has refused to answer questions. Despite no formal ties to KMG, Kulibaev still enjoys numerous connections in the oil industry. Undoubtedly, these connections allowed him to establish a personal acquaintance with the prince, whose official duties include facilitating contracts between British companies and foreign shareholder companies.

According to a Kazakh politician, in May, during one of his recent private visits to Kazakhstan, the prince met with representatives of KMG. The prince was also seen there in November; shortly after his official visit, he returned to the country for private matters.

On that occasion, Andrew was spotted at the “Soho” bar in Almaty. As rumors have it, he was once again in the company of KMG top managers, along with a brunette who was showing him attention. An eyewitness reported, “It seems Andrew was genuinely enjoying himself. He spent the entire evening with this vibrant dark-haired woman, who seemed to be Russian. Corrupt officials in Kazakhstan orchestrated a grandiose scheme with the help of the former owner of Kazkommertsbank (Qazkom), a shareholder of BTA Bank, Kenes Rakishev. The elaborate maneuver, involving the “young oligarch” of the Kazakh state treasury, cost at least $7.5 billion.

Rakishev became overly engrossed in mergers and acquisitions, and the Russian-Ukrainian war that began in 2014, the imposition of sanctions against the aggressor country, and the subsequent drop in oil prices, crucial for the Kazakh economy, significantly impacted the capital tied to Kenes.

Even before the crisis, in 2012, Kazkommertsbank undertook a highly risky acquisition of BTA Bank. Sometime in 2013 (according to other sources, in 2014), Rakishev became the chairman of the board of directors of BTA. The cost of acquiring this company and the subsequent restructuring of problem loans amounted to about $20 billion. This became a serious problem for Qazkom – in mid-2014, BTA’s troubled loan portfolio accounted for 2.4 trillion tenge ($7.5 billion), nearly 90% of the loan portfolio of the absorbed financial institution.

In 2014, the acquisition of BTA Bank by Kenes Rakishev and Kazkommertsbank was announced. In 2015, Kenes Rakishev became the owner of a controlling stake in Kazkommertsbank. Around the same time, Kazkommertsbank opened a credit line of 2.4 trillion tenge ($7.5 billion) to BTA Bank, which was then controlled by Kenes Rakishev. Later, these 2.4 trillion tenge would become “problematic loans.”

Sometime earlier this year, rumors surfaced that Kenes Rakishev would sell Qazkom in bulk along with BTA Bank. On June 15, the deal amount became known – 1 tenge (if you’re curious, as of August 12, 2017, $1 is worth 333.17 tenge).

But the gossip was wrong: BTA Bank, cleared of debts at the expense of Kazakh taxpayers’ funds, allowed Rakishev to keep it (but not necessarily forever).

It was anticipated that the Fund for Problem Loans of Kazakhstan (meaning the state using taxpayers’ money) would purchase the problem loans from BTA Bank worth 2.4 trillion tenge ($7.5 billion). Note that this figure aligns with the amount of the credit line that Kenes Rakishev essentially opened for himself. BTA Bank transfers this money to Kazkommertsbank as a repayment of the debt. Subsequently, Kenes Rakishev was supposed to sell shares of Qazkom, which included BTA Bank, to Halyk Bank for a symbolic amount.

Timur Kulibayev, the son-in-law of President Nursultan Nazarbayev of Kazakhstan, is the ultimate controlling shareholder of Halyk Bank through controlled structures. Detractors claim that Kulibayev and Rakishev have such strong friendly relations that it’s risky to publicly discuss all the details of their friendship due to potential legal action.

Meanwhile, according to recent news, the “Rakishev scheme” has come full circle.

On July 5, Kulibayev’s Halyk Bank finally purchased 86.09% of Kazkommertsbank shares from Kenes Rakishev for a symbolic 1 tenge. On July 31, it became known that Kenes Rakishev had stepped down from the board of directors of Qazkom. On August 3, a statement was released that Kazkommertsbank considered the credit line of 2.4 trillion tenge ($7.5 billion), provided to BTA Bank in 2015 and later controlled by Rakishev, as repaid. It’s worth noting that this amount was not transferred by Kenes Rakishev from his accounts; rather, it was taken out of the pockets of taxpayers by the State Fund for Problem Loans of Kazakhstan. The convoluted scheme, Eastern in its intricacy, is worth examining once again: Kenes Rakishev, under the guise of a credit line from one bank under his control, transfers an astronomical sum to another. Over the course of a year, billions evaporate from BTA Bank, moving into the realm of problematic loans—those that are unlikely to be repaid. This year, a friend of the former owner of the lending bank acquires Qazkom, and a Kazakh state structure purchases the “hole in the bagel” from BTA for $7.5 billion, with the money moving into Kazkommertsbank, now owned by President Nursultan Nazarbayev’s son-in-law, Timur Kulibayev.

Meanwhile, Rakishev, according to information from the official website of BTA Bank, has concentrated nearly 100% of the company. It appears that he has initiated a massive sell-off of the bank’s assets abroad.

For instance, the Ukrainian branch of BTA recently decided to divest its most valuable assets in Kiev—business centers “Prime” and “Eurasia.” Notably, the announcement of the actual sale of this real estate coincided with Rakishev’s departure from Kazkommertsbank. Meanwhile, the activity of Rakishev’s PR team in the Ukrainian information space indicates that the “young oligarch” from Almaty is not planning to leave us just yet.

On December 14, 2015, the Italian, accompanied by dozens of fighters, arrived at Elements to demand the same 8 million rubles from Kim. Shortly thereafter, lawyer Eduard Budantsev arrived with his subordinates to intervene on behalf of Zhanna. Much has been written about the subsequent events. A fight ensued, followed by gunfire. As a result of the brawl that claimed two lives, the Italian, Budantsev, and later Kalashov were arrested. Rakishev remained on the sidelines and could comfortably boast about not only “taking care of” the most influential “thief-in-law” but also “rolling him up” in pre-trial detention.

Why did Kenes stay on the sidelines? During the initial interrogations, Budantsev claimed that Kim had been his client since 2014, and she herself called him on December 14, and he immediately came to Elements. However, it was later revealed that everything was completely different.

Recently, hearings for three officers of the Presnensky District Internal Affairs Directorate — Renat Zinnatuliny, Ildar Shakirov, and Denis Romashkin — came to their conclusion. They are accused of being at Elements during the massacre and not intervening in the proceedings. During the trial, case materials were presented, and Budantsev’s testimony was reiterated. New information revealed that it was Rakishev who initiated the “showdown”, and perhaps he did it not by accident.

During the hearings, Budantsev confessed that he had never heard anything about Zhanna before December 14. Unexpectedly, his long-time client Kenes Rakishev, with whom he had developed a friendship, called him and urgently asked him to come to Kim because someone was demanding money from her. However, Rakishev did not warn Budantsev that he would have to deal with Shakro’s people, even though he clearly knew this.

This testimony was fully supported by the detailed call records, which showed that on December 14, Budantsev did not contact Kim. Instead, calls were documented between Zhanna and Kenes Rakishev, and later between Rakishev and Budantsev.

Another piece of evidence that events unfolded precisely according to this scenario is the recording made by Kim herself on December 14 at Elements. When Budantsev arrived at the restaurant, he didn’t even know what the owner looked like and asked, “Are you the owner here?” After receiving an affirmative answer, the lawyer introduced himself, stating that he had come at Kenes’s request.

Now, the fact that Rakishev initiated this entire story leading to Kalashov’s imprisonment becomes indisputable. How the Kalashov camp will react to this and whether they will leave it unanswered will be revealed over time.

The shootout on Rochdelskaya Street stemmed from a dispute between Elements restaurant owner Zhanna Kim and designer Fatima Misikova. Misikova claimed that Kim had not paid her an additional 8 million rubles for the repairs. In December 2017, lawyer Eduard Budantsev underwent re-interrogation in the Presnensky District Court due to numerous discrepancies in his testimony. Judge Tatyana Vasyuchenko agreed to the re-interrogation to address these inconsistencies. During the hearing, the court meticulously compared Budantsev’s statements with audio and video recordings of the incident and details of phone calls. For instance, Budantsev initially claimed he went to the Elements restaurant after a call from Zhanna Kim seeking help in negotiating with unknown individuals demanding repayment of a debt.

However, it was revealed in court that such a call was not recorded, and Kim’s conversation was not present in the audio recording. Instead, Kim recorded the meeting on a tape recorder an hour before the shooting.

When Budantsev’s deception became apparent, he asserted that everything merely seemed that way to him. He also claimed that Kim had informed him that the extortionists’ demanded amount had increased. It gives the impression that Judge Vasyuchenko sought to handle the case in accordance with the law and was intent on uncovering the truth. Perhaps this is why, instead of being appointed as the chairman of the Kuntsevsky court, a position she was preparing for, she was dismissed.

It is now evident that the criminal case, which triggered the fourth military war, was orchestrated for a specific purpose: to extricate Budantsev from potential consequences. His patrons were evidently apprehensive about public scrutiny. The lawyer’s falsehoods in court provide a compelling reason to reevaluate the events of those days and hold Budantsev accountable for perjury. In a scenario where the court adhered to the law, it would likely have concluded that there were no justifiable grounds for Budantsev’s use of weapons, potentially leading to him facing charges of murder.

However, reality does not entertain hypotheticals. Budantsev’s lies were exposed during the investigation, but under the direction of senior investigator Konstantin Krivorotov, working under the chairman of the ICR, the case was deliberately slowed and halted. Budantsev remained free, and Krivorotov received the Order of Courage for purported “courage and selflessness in the line of duty.”

How Kenes Rakishev and Zhanna Kim initiated the Rochdelskaya massacre

“Rucriminal” has access to transcripts of court hearings and a criminal case involving police officers unjustly accused of not intervening in the Elements restaurant shootout involving its owner, Zhanna Kim.

From these materials, it is evident that Kim is not truthful during interrogation about the alleged extortion at the Elements. Surprisingly, the Kazakh businessman was never interrogated regarding the case. Kenes Rakishev appears to shield himself, being the one who dispatched Budantsev for a “showdown” with Kim’s adversaries, making him culpable for the bloodshed. In another photo, published for the first time by Le Média, Rakishev is shown holding an assault rifle, his index finger raised to the sky like Daesh jihadists. It has to be said that Rakishev shares the same radical conception of Islam as Kadyrov. One of the Kazakhstani’s companies has also become the sponsor of Akhmat Grozny, the Chechen capital’s football club, nicknamed the “Football Club Ramzan Kadyrov”.

Rakishev’s strange friendships are not limited to the Caucasus. In 2007, he negotiated the purchase of a mansion from Prince Andrew of York, the son of the Queen of England, recently implicated in the Epstein affair. The mansion was acquired for £15 million, over £3 million more than its real value. Could Elizabeth II’s youngest son have been corrupted by the Kazakh regime? In any case, the affair caused quite a stir on the other side of the Channel, but Rakishev was able to keep his head above water. The oligarch also has a long arm in the USA, where he met Joe Biden, and in France.

A streetcar named “corruption”

In the late 2000s, Kazakhstan became an Eldorado for our companies. Nicolas Sarkozy signed major commercial contracts with Nazarbayev’s regime, worth a total of almost 2 billion euros. Some of these contracts will be the talk of journalists… but also of court clerks. French justice will be taking a close look at the sale of 45 helicopters to Kazakhstan, an order placed with Eurocopter that is said to have given rise to substantial kickbacks to Nicolas Sarkozy’s entourage. For its part, Alstom signed an agreement to build locomotives in Kazakh factories. The French energy and transport giant has been promised the construction of the tramway (or LRT, for “light rail transit”) for the new capital, which Nazarbayev intends to shape according to his megalomania. The foundation stone was laid with great fanfare in 2011. But the project stalled. The all-powerful president finds Alstom’s bill far too high, and is considering awarding the contract to another company. The 1.46 billion euros promised for this pharaonic project are likely to end up in other pockets.

In a confidential letter dated September 2, 2013, addressed to the mayor of Astana and revealed for the first time by Le Média, Alstom is alarmed: “The president of our company, Mr. Patrick Kron, received information from the president of the Republic of Kazakhstan that our proposal was too expensive and we were asked to reduce our price to fit the allocated budget. We reworked and submitted a counter-proposal of 1.315 billion euros (excluding taxes). This counter-proposal received no response. The French transport and energy giant then tried to put all the odds on its side. In “highly confidential” email exchanges that Le Média was able to consult, Christian Loubet, then Alstom’s business development director for the Caucasus and Central Asia, wrote on August 26, 2013 to a certain Mukhamedzhan Alzhanov, a businessman based in Russia: “I really need your help, we can’t win without your help. […] Today, the vice-mayor of Astana is working hand in hand with a Spanish company. Please, can you pass on some messages to your best friend in Kazakhstan?”

This best friend is none other than Kenes Rakishev, whom Christian Loubet describes on the phone as “very dangerous”. And yet he’s the man Alstom needs to turn around a situation that’s well and truly out of hand. Rakishev not only has the ear of President Nazarbayev, he is also the son-in-law of the then mayor of Astana, Imangali Tasmagambetov. The oligarch also sits on the board of Kazakhstan Engineering, a state-owned company specializing in several engineering sectors (hydrocarbons, modernization of military equipment, etc.) and in the rail industry, which is of particular interest to Alstom. The French group maintains close ties with Rakishev. In December 2010, it even paid him as a consultant. Although Alstom denies “having any knowledge of a consultancy contract involving Kenes Rakishev”, Christian Loubet finally admits that this consultancy did exist, “not for the Astana tramway, but because Kenes Rakishev was working on the Almaty metro (editor’s note: the economic capital). We visited what he and Hyundaï had done in Almaty. I had to see him, and at the end we asked him what advice he could give us for our Astana project, but we realized that he was useless, that he didn’t know anything technically, so we dropped him”. Alstom would nevertheless continue to rely on Kenes Rakishev’s contacts for several years to come. In 2014, when Astana’s tramway project was in danger of being abandoned in favor of a bus network, the French group even shifted up a gear with the oligarch.

On March 16, 2014, Christian Loubet made a surprising proposal to Rakishev, who, let’s not forget, holds a position within a Kazakhstani company. He offered to set up a partnership between Alstom, KTZ (the local SNCF) and one of Rakishev’s companies, to install signalling systems on the local railroad. The contract is valued at between 60 and 70 million euros, according to a confidential document obtained by Le Média. This isn’t the first time Alstom has tried to curry favor with Rakishev, and his help with the Astana tramway. In 2012, Christian Loubet had already proposed that the oligarch invest in copper exports to Portugal. He would later put him in touch with the French group Vinci to build parking lots in Astana. “It’s normal for French companies abroad to help each other,” says Christian Loubet, who assures us that he has always acted in consultation with Alstom’s general management.

Despite all their efforts, the French group never won the tramway contract. It has to be said that in October 2014, Kenes Rakishev’s father-in-law stepped down as mayor of Astana. “We had been negotiating for two years. The day Patrick Kron (editor’s note: the CEO of Alstom) came to sign the contract, the minister sent us someone at seven in the morning to tell us that Kazakhstan was no longer signing. We were sorely kicked off the project. That’s why I lost my job at Alstom,” says Christian Loubet. The new mayor of Astana convinced Nazarbayev to entrust the tramway to a Chinese consortium, but without any further success. The white elephant was abandoned. The disaster was both economic and moral, with embezzlement estimated at several hundred million dollars. Alstom was not spared the scandal. The company once again finds itself embroiled in a case of bribery of a foreign public official. Already, in April 2013, an Alstom executive was arrested in the United States, having been charged by the FBI with bribery in Indonesia. This executive, Frédéric Pierucci, will be used as a hostage in General Electric’s (GE) merciless war against Alstom. Alstom’s energy division was eventually acquired by GE. At the end of 2014, the turbines powering our nuclear power plants and submarines came under U.S. control, without the then Minister of the Economy, a certain Emmanuel Macron, lifting a finger.

A very expensive “Legion of Honor”

But Kenes Rakishev’s story with France doesn’t end there. It was December 30, 2013, and the oligarch received a curious e-mail, to say the least: “Financial side: 200,000 euros, half to start the operation, the other half on receipt of the official letter. Duration of the operation: 3 months from the date of the first payment”. To which Rakishev replies, “That’s fine by me”. This time, the multimillionaire is not looking to invest in some obscure joint venture with one of our industrial flagships. He doesn’t want commissions; he wants something more ego-satisfying: decoration. A French businessman by the name of Fabien Baussart has offered to find him a home-grown Legion of Honor. Contacted by Le Média, Baussart quickly cut short our questions, promising to have us called by a London law firm and threatening to take us to court in the UK. It has to be said that the businessman has a sulphurous reputation. In 2006, he founded an obscure think-tank, the Center of Political and Foreign Affairs (CPFA). Over the years, this think-tank has made a name for itself with proposals that are, to say the least, disruptive: Baussart nominated Vladimir Putin for the Nobel Peace Prize in 2016; he awarded a prize to Ramzan Kadyrov for his “fight against terrorism”; and he was behind a plan for peace in Syria… supported by the Kremlin and the great Kazakh democrat Nazarbayev. Baussart is well known in Moscow, where he is received by Foreign Minister Sergei Lavrov, but also on the other side of the Atlantic. In 2016, at the height of the race for the White House, he brought Donald Trump’s son to Paris, giving credence to the theory that Putin’s networks were supporting Trump’s campaign.

Fabien Baussart is a frequent visitor to the oligarchs of the former Soviet Union. Not only does he enjoy parallel diplomacy in the service of the Kremlin, he also likes to render small services to the big boys. Small favors that obviously don’t come without a price. In fact, Kenes Rakishev will pay the first instalment of the 200,000 euros agreed for Baussart to win him a French Legion of Honor. On January 7, 2014, a transfer of 100,000 euros was issued to a company registered in the Seychelles, Atargatis International Holding Ltd, ostensibly owned by Baussart. Less than a month later, however, Kenes Rakishev is already losing patience. He wants his Legion of Honor without further delay. A close Russian-speaking friend of Fabien Baussart, who acts as an intermediary and sometimes translator, complained to the oligarch in an e-mail dated January 24: “Sorry, but your assistant is behaving strangely. He is pursuing Fabien, demanding immediate results. This is unacceptable.” Finally, it was after six months of waiting that, on July 17, 2014, Fabien Baussart was able to write to Kenes Rakishev: “I received your decoration yesterday.” The email is accompanied by a rather blurry photo of what appears to be a Legion of Honor medal still in his box. “To the best of our knowledge, Mr. Rakishev has never received a Legion of Honor,” Fabien Baussart initially denied, before referring us to his lawyers when we confronted him with his exchanges with Kenes Rakishev. Contacted to find out whether this decoration is indeed genuine, the Grand Chancellery of the Legion of Honor dismissed the question: “As the attribution of the Legion of Honor to foreigners is not published in the Official Journal of the French Republic, we are unable to confirm or deny that Mr. Rakishev has been awarded it”.

True or false, the Legion of Honor awarded to Rakishev opened other doors for Fabien Baussart. In the summer of 2014, he landed a lobbying contract for the Kazakhstani bank BTA, whose new chairman of the board was none other than… Kenes Rakishev. Fabien Baussart fulfills his part of the contract, at least on the surface. He tells the oligarch that he is arranging meetings with the then Minister of the Economy Arnaud Montebourg and his chief of staff Boris Vallaud (contacted by Le Média, neither has any recollection of meeting Baussart). The businessman also boasts of having “the support and green light” of the then Secretary General of the Elysée Palace, Jean-Pierre Jouyet.

While Baussart’s lobbying may sometimes seem imaginary, his remuneration by Kenes Rakishev is very real. 380,000 euros were thus paid into the account of a Seychelles-based company, Fridhem Ltd. In a July 25, 2014 e-mail to the oligarch, Fabien Baussart justified this tidy sum: “I need to pay certain people”. Quite a program.

How was Kenes Rakishev involved in the ‘kickback’ scheme with the Queen of the United Kingdom’s middle son?

British Prince Andrew received £4 million as a ‘kickback’ for assisting in organizing a £385 million deal through Kenes Rakishev.

This news, brought to light by the widely read Daily Mail in the UK, has stirred public opinion.

“A disgrace to the royal family,” said former Liberal Democrat Member of Parliament Norman Baker. And this is more than just a remark. It effectively mirrors the public sentiment towards the unfolding events.

But what exactly happened that could significantly shake the British throne? Nothing extraordinary, if viewed from the perspective of Kazakhstani practices. Two companies — Greek and Swiss — formed a consortium that decided to engage in the construction of water supply and sewage systems in Almaty and Astana. In the process, they sought consultation from Prince Andrew, who had already earned a reputation as a ‘Kazakhstan specialist.’ As a result, a commission for the prince was established for his consultation — one percent.

With approval granted, Prince Andrew sought support from Kazakh businessman Kenes Rakishev, who swiftly organized several meetings for the royal figure with the heads of Astana and Almaty. And £4 million found its way into the pockets of the royal figure.

In principle, there’s nothing particularly unusual about the close ties between the British prince and representatives of the Kazakhstani establishment. As far back as 2007, Kenes Rakishev purchased an abandoned mansion from Andrew, paying an exorbitant sum—around £15 million. However, at that time, no significant conclusions were drawn from this story.

The situation has now taken a different turn. If in 2007 all talk of inadequate valuation and hidden bribes largely remained opinions of journalists, this time, the Daily Mail’s asset became the correspondence between Prince Andrew and Kenes Rakishev. It reveals that this was not a mere coincidence but a genuine conspiracy — on one side, a member of the aristocratic family, on the other, a representative of the corrupt elite from Kazakhstan. In other words, a scandal erupted in the noble family, immediately picked up by other media. After all, the prince was caught red-handed.

What is especially humiliating is that representatives of Andrew attempted to distance themselves from direct questions from journalists. The issue is that they couldn’t even fathom that the correspondences in their possession left no room for any other interpretation. It turned into a genuine disgrace. It’s one thing to take money in Kazakhstan, and an entirely different matter to be caught in the act at home, next to Buckingham Palace.

[Excerpt from “MK-London,” 23.05.2016, “Royal Family Member Suspected of Involvement in Corruption Deal in Kazakhstan”: The facts mentioned in the investigation date back to 2011 when Prince Andrew held the position of the UK’s special representative for trade. A request for mediation was received from a Greek-Swiss consortium, and the deal was supposed to be facilitated through a relative of the then mayor of Astana […] Rakishev. The Duke of York had been acquainted with Rakishev since 2007 when he acted as a broker for the sale of the prince’s estate in Berkshire, selling it for three million pounds above the starting price to businessman Timur Kulibayev, the son-in-law of President Nursultan Nazarbayev. As reported by The Daily Mail, Prince Andrew completed his mission, bringing together the interested parties and receiving the due compensation. However, the deal was later terminated: at the end of 2011, the Kazakh city of Zhanaozen experienced mass riots in which at least fifteen people were killed by the police, and EYDAP chose to withdraw from Kazakhstan to avoid damage to its international reputation.

The Buckingham Palace press office has already issued a denial, explaining that the materials from the journalistic investigation have been handed over to the legal representatives of the royal family: “The statement that the Duke of York had any financial interest in mediating in a deal between an international consortium and the Kazakh government is false, offensive, and violates the code of journalistic ethics.”

It turns out there’s an entire website dedicated to Kenes Rakishev, the alleged proxy owner of Nazarbayev, who supposedly owns Kazkommertsbank and BTA Bank. Nazarbayev decided to formalize part of his assets under the new proxy “businessman” Rakishev, artificially turning him into a billionaire. It became challenging to register gigantic assets under the same individuals like Bolat Utemuratov, Mashkevich, Timur Kulibayev, Bolat Nazarbayev, and Kayrat Satybaldy.

They decided to create a new “talented” billionaire. And so, Kenes started a new glamorous life… If only he knew how to manage banks and business, he would have been worth the price. But they let the spoiled boy near the money, and off he went, partying. He partied so hard that now 2 trillion tenge has to be injected from the country’s budget, and Kazkommertsbank has to be re-registered again under Timur Kulibayev… It’s tough being a public figure, Kenes. And you thought, oh, how cool! A star now…

Serious banks refuse to collaborate with the Kazakh oligarch

President Nursultan Nazarbayev has stepped down in Kazakhstan. While it’s clear that he won’t relinquish power in the country, theoretically, it’s now the perfect time for him to scrutinize his pension fund. The businessman Kenes Rakishev was responsible for forming it, along with handling the overseas assets of Nazarbayev‘s son-in-law, Timur Kulibayev. However, Rakishev performed these tasks poorly, as detailed in recent publications. The issue lies in the fact that mostly international adventurers agree to collaborate with Rakishev.

Once again, Rakishev decided to “successfully” invest funds, and a “lively” group crossed his path: Jay Johnston, a specialist in fund withdrawal to “tax havens,” his “right-hand man” Francesco Piovanetti, and Ferrari racing enthusiast Mike Zoi. They “sold” Rakishev a stake in Net Element, and he immediately announced another successful investment. In reality, Net Element was composed of numerous internet resources, including actor Kaan’s website and musician Igor Krutoy‘s content-based music service. All Net Element internet companies turned out to be unsuccessful, and the company’s stock prices plummeted on the market. To salvage the situation, Rakishev decided to purchase and merge Unified Payments, a credit card processor owned by Oleg Firer, with Net Element. Rakishev was so impressed with Firer that he appointed him as the CEO of Net Element.

Credit for Rakishev? No, he manages Nazarbayev‘s money.
It turned out that Firer, in reality, was the son of Odessa emigrants who was deeply in debt and entangled in lawsuits due to a past failed business. He took out loans to open a chain of stores selling pornographic publications. Thanks to the deal with Rakishev and his new job, Firer not only paid off his debts but also upgraded to a new Bentley.

And Net Element’s stock prices continued to fall.

To justify himself before Nazarbayev and Kulibayev, Rakishev started collaborating with what he thought were American business “monsters” – the heads of Platinum Partners, Murray Huberfeld, and Mark Nordlicht. Kenes even organized a visit for Nordlicht with all the honors to Kazakhstan, where the Platinum Partners representative met with Kulibayev and discussed possibilities for investing Kazakh funds. Shortly thereafter, Huberfeld and Nordlicht were arrested in the U.S. Huberfeld faced charges of bribing the head of a union to invest pension funds in Platinum, and Nordlicht faced accusations that Platinum attempted fraud amounting to billions of dollars.

Why, then, do serious banks and entrepreneurs not collaborate with Rakishev? This becomes evident from the businessman’s leaked correspondence, which is available. Rakishev himself confirmed under oath in a U.S. court that his email account was hacked.

When Net Element’s situation worsened (the company was generating losses year after year), Rakishev instructed them to take a loan from the IFC – a division of the World Bank. On November 20, 2013, Net Element’s top manager, Tim Greenfield, wrote a letter to IFC representative Kay Martin:

“Kay, we enjoyed meeting with you and your team and look forward to continuing the dialogue. Please find below the link to the presentation we gave. We are finalizing the financial model, which we will share with you soon.”

Kay Martin’s response came six days later, and it was far from comforting:

“Tim,
Thank you for your visit and presentation. We were pleased to learn about your business and consider it an interesting opportunity.
Unfortunately, your investor from Kazakhstan manages the president’s family money, and we cannot invest with them (due to our mandate). I’m sure they are the best investor in their part of the world, but we are not allowed to invest with people with political risks.
We are still interested in discussing the possibility of doing something with SafetyPay if you are also interested. Sorry, no better news.
Kay”

Tim Greenfield immediately forwarded this letter to Oleg Firer, who sent it to Rakishev with the following message:

“Hello, Kenes. I worked with the World Bank regarding the loan and investments in NET; after the due diligence, they emailed me their response this morning. Please let me know if their findings are correct so that I can act accordingly.”

Rakishev’s response to Firer is extremely brief: “What does this mean?”

Firer, as evident from the document, begins to justify himself:

“I have no idea; I just forwarded to you what the World Bank says – that you are connected with the president of Kazakhstan by managing his money. If it’s true, that’s fine; I want to go back to them and either agree or disagree and say that it’s not true.”

This is where the topic of obtaining a loan from the World Bank fizzled out. Since what Kay Martin wrote is absolutely true.

And it becomes clear why serious businessmen and banks do not want to collaborate with Rakishev. Firstly, it’s not his money. Secondly, working with Nazarbayev’s funds is dangerous. He may cease to be president (which happened), and serious financial risks may arise. Even worse, these funds can be declared “dirty” and illegally withdrawn from Kazakhstan at any moment.

Rakishev is unaware of the activities of his purported BTA Bank

We continue our series of articles on the American testimonies of the Kazakh oligarch Kenes Rakishev.

These were voiced by Rakishev in a US court, where the lawsuit of BTA Bank against the former owner of the bank Mukhtar Ablyazov, the former mayor of the capital of Kazakhstan Viktor Khrapunov, and his son Ilyas Khrapunov was considered. The lawyers of the latter tried to prove in court that Rakishev is only a nominal owner of BTA Bank. In reality, the bank is controlled by people from the top of Kazakhstan, and it is these people who are behind the persecution of Ablyazov and the Khrapunovs. The names of these individuals from the top echelons, with whom Rakishev personally communicates, were disclosed. Kenes himself confirmed the fact of close communication directly with them or their representatives. These individuals include the head of the National Security Committee Karim Masimov, the son-in-law of the President of Kazakhstan Timur Kulibayev, and personally Nursultan Nazarbayev. All these names are in the interrogation protocols of Rakishev, a certified copy of which is available to rucriminal portal. And when the lawyers for the defendants began asking questions about the specific activities of BTA Bank, where Rakishev was the Chairman of the Board of Directors at the time of the interrogation, he clearly struggled. He could not answer questions about BTA’s counterparties, the bank’s agreements, the countries where it is involved in litigation, and so on. An interesting Chairman of the Board of Directors who knows absolutely nothing about the bank, where he is the main owner. Rucriminal publishes a transcript of this part of Rakishev’s interrogation.

A: Kazakhstan, Ukraine, the USA, Russia, there is something else, but I can’t tell you right now because I don’t remember or I don’t know.

A: What do you mean by authorities? If you mean law enforcement agencies, yes; authorities, no.

According to an investigation, Rakishev played a significant role in the construction of Kadyrov’s lavish palace in Chechnya. Situated on the banks of the Sunzha River, the palace boasts 13,000m2 of carpets, 4,000m2 of tapestries, and is surrounded by a garden adorned with 16,000 roses.

The amount obviously did not confuse the customers, because soon the Italians sent Rakishev an estimate for the arrangement and furnishings of two rooms – the presidential office (110 sq. M.) Firer’s Miami narrative unfolded just as the stories of Victor and Natalia Wolf were concluding. The Wolfs, like other fraudsters during the South Florida real estate boom, amassed wealth by flipping properties. Operating from their North Miami Beach home on the Intracoastal, hosting investors on a luxury yacht, they sold stakes in developments in Texas and Florida that eventually failed, causing investors and lenders to lose over $20 million. As their scheme collapsed, the Wolfs fled in 2006, transferring the title of their mortgaged house to G & G Property Investments before leaving.

Firer acquired G & G, which then deeded the home to him. However, trouble arose when Firer sought a mortgage on the property. An affidavit by a state attorney investigator accused him of inflating its value by $1 million and misrepresenting $850,000 as an asset instead of the proceeds from a loan. Firer faced two counts of mortgage fraud, and substantial funds were seized, later mostly returned when the charges were dropped. The records, though sealed, have been examined by the Miami Herald.

The multiple mortgages led to a prolonged legal battle over home ownership, ongoing for 12 years. In a bizarre turn, Firer is currently suing himself as a representative of one of his business associates’ companies.

The home, once the center of the Wolfs’ fraudulent activities, retains its external appearance. Four classical statues border the street, thin Ionic columns support the portico, and painted gold lions guard the front door. Firer mentions that he and his family reside there part-time.

Reflecting on acquiring the house, Firer considers it a significant mistake due to its entanglement with the Wolf saga. He expresses bewilderment at being tied to these elusive figures, who remain on the FBI’s most wanted list for white-collar criminals.

When questioned about his knowledge of the Wolfs in an interview with the Herald, Firer denied meeting the infamous pair. However, a 2007 civil suit deposition contradicts this, revealing that Firer did meet Victor Wolf in the summer of 2006. The meeting involved discussing a loan, followed by lunch at a sushi restaurant. Firer, when confronted with the inconsistency, suggested that many people sought loans from him, and Victor Wolf might have been one of them.

A GANGSTER AND HIS ‘B-GIRLS’

Three years after becoming entangled in the Wolfs’ former house situation, Firer’s name surfaced in federal court in connection with the South Beach bar girl scam orchestrated by an admitted Russian mobster named Alec “Oleg” Simchuk.

The “B-girls” operation, a highly organized scam, employed young women recruited from Eastern Europe to lure tourists from upscale hotels. They would coax them into visiting Russian-themed bars, ply them with drinks, and trick them into charging exorbitant amounts on their credit cards for overpriced drinks and caviar. Stanislav Pavlenko, testifying in the B-girls trial, described his role in setting up credit card processing for Caviar Bar while working at Firer’s venture capital business, Star Capital Fund. Pavlenko mentioned that Firer directed an assistant to help him create the merchant account.

Simchuk, the gangster behind Caviar Bar, testified about opening the bar with Pavlenko’s assistance and establishing the credit card account. Evidence suggested that Firer’s assistant submitted letters to American Express defending fraudulent charges.

Initially, Firer vehemently denied working with Pavlenko, calling it “hearsay” when confronted with the court testimony. He affirmed knowing Pavlenko personally, having been acquainted with him since their time in Brooklyn, and mentioned that Pavlenko was a helpful resource when he moved to North Miami Beach.

Pavlenko was sentenced to six and a half years but later released due to a judge’s mistake in issuing jury instructions, with a condition to return to Russia. Another individual convicted in the B-girls case, Albert Takhalov, had his conviction overturned for similar reasons and now operates in the same field he allegedly abused, with his company, Discover Data, registered as an agent of Unified Payments, now controlled by Firer’s Net Element.

When questioned about the situation, Firer stopped responding to inquiries from the Miami Herald. His representative later challenged some aspects of the published story, disputing Pavlenko’s affiliation with Star Capital and denying any involvement in the B-girl scam.

THEIR MAN IN MOSCOW

In the latest chapter of Firer’s journey, he finds himself in Grenada, where he has been serving as ambassador to Russia since 2017.

According to Firer, his initial invitation to the island came from the Grenadian government to explore applications in telemedicine, specifically the use of technology to enable virtual interactions between doctors and patients in the Caribbean.

While in Grenada, he developed a connection with Olinga Mitchell, the son of Prime Minister Keith Mitchell. Firer acquired Grenadian citizenship through his investment in the island, as reported by the news agency Caribbean News Now!

Becoming Grenada’s first ambassador to Russia since the countries resumed diplomatic relations in 2002, Firer had the opportunity to present his credentials to Vladimir Putin, commemorated with a keepsake photograph. His appointment occurred amid concerns raised by some Caribbean journalists and local activists about Russia’s growing influence in the region.

Caribbean News Now!, among those expressing concerns, went so far as to suggest that Firer might be assisting the Russians in gaining control of Grenada’s nutmeg production. This story drew attention, and after its publication, the news agency reported an alleged attempt by a mysterious computer programmer or hacker to offer $5,000 to take down the article from their website. When Caribbean News Now! declined, the programmer reportedly hinted at a potential cyberattack.

After the online publication of this story and weeks of not responding to queries, Firer contacted the media outlet, asserting that his Grenadian citizenship was unrelated to his investments and denying any involvement in nutmeg-related activities.

Kenes Rakishev’s Nasdaq-listed Special Purpose Acquisition Company (SPAC), Oxus Acquisition Corp. (“OXUS”), is reportedly considering a takeover bid for Battery Metals Technologies (BMT), a nickel and cobalt mining company in which Rakishev holds a significant investment.

Oxus, which secured $176 million in a New York listing last year, aims to invest in energy transition companies, particularly those in the electric vehicle market. However, the potential acquisition of BMT raises controversy as Rakishev, the sponsor of Oxus, would essentially be using investors’ funds to acquire a company in which he has a substantial interest.

Despite being listed on the Nasdaq exchange since September, Oxus has yet to finalize any deals, though it has been associated with various potential companies. A potential deal with BMT would grant Oxus control over Kazakhstan’s largest nickel and cobalt development project, strategically located near electric vehicle battery manufacturers in China.

BMT is fully owned by Ferronickel Plant Ertis LLP, with a majority stake held by Fincraft Resources, a holding company listed on the Kazakh Stock Exchange, where Rakishev owns a 97.85% stake. Kenes Rakishev has faced controversy before, notably in a 2020 US Senate investigation linking him to financial transactions with an associate of Hunter Biden, the son of the US President. How an Emissary of a Prominent Chechen Leader Resolved Russian Business Disputes, Leaving with Millions

The Chechen Republic stands as one of Russia’s economically challenged areas, heavily reliant on financial aid from the central government to sustain its budget.

However, despite its economic struggles, the region’s influential figures display conspicuous affluence. Ramzan Kadyrov, the enduring Moscow-backed leader of Chechnya, indulges in passions such as thoroughbred horses and exotic animals. He extends invitations to Hollywood stars for his birthday celebrations, and his daughter even organized a fashion show in Paris. Kadyrov, known for his opulent lifestyle, once showcased his expensive cars and luxurious surroundings on Instagram before being banned from the platform.

Kadyrov claims that his money comes from God. However, the elites in Chechnya also have more tangible sources of income. Reporters from The Project, an independent Russian publication and OCCRP partner, have documented multiple business disputes where a relatively unknown Russian businessman, Pavel Krotov, has intervened to broker resolutions—only to end up with a significant portion of the assets.

In each profitable case, sources indicate that Krotov was representing the interests of Adam Delimkhanov, a member of the Russian parliament and one of the most powerful politicians in the Chechen Republic, following Kadyrov.

While aspects of these stories have been reported independently, emails exchanged by Krotov and obtained by reporters, along with new interviews with insiders, corporate records, and property records, reveal that his involvement in each dispute was part of a larger pattern.

An authenticated police document seems to confirm what multiple sources are hesitant to state on the record: Krotov’s methods included using force against opposing parties. In an investigation into a formal complaint against Krotov, police noted that the businessman employed “unjustified criminal-law methods of influence.” In interviews, several sources conveyed to reporters that Krotov had a tendency to invoke his connections to Delimkhanov, causing them to fear for their safety and decline to be quoted by name.

None of the main parties involved in the described business conflicts agreed to speak to reporters on the record. Most of those contacted refused to provide information under any circumstances.

Krotov himself denies any connections to Chechen politicians, dismissing reporters’ questions as “pure nonsense.”

“I’ve never been any kind of negotiator,” he stated. “I do business. I work to create.” Krotov claimed that all his investments were made with his own money and that he has no acquaintance with Kadyrov or Delimkhanov. “As an Orthodox Christian Russian person, I definitely don’t work for any Chechen elites,” he added. He also denied numerous specific claims related to the cases where he allegedly resolved disputes.

Representatives of Delimkhanov and Kadyrov did not respond to requests for comment.

“Closer Than a Brother”

Ramzan Kadyrov has been effusive in his praise for Adam Delimkhanov, even going so far as to designate him as his potential successor, stating, “I’ve prepared a person who can replace me.” In 2009, Kadyrov referred to Delimkhanov as his closest friend, closer than a brother.

During the 1990s, reports indicate that Delimkhanov worked as a driver for Salman Raduev, a notorious Chechen terrorist responsible for taking hundreds of civilians hostage during the first Chechen war. However, in 1999, Delimkhanov switched allegiances, actively participating in operations against Chechen militants and surviving an assassination attempt.

Delimkhanov’s penchant for violence is well-known within Russia’s parliament. In one incident, following a disagreement with a fellow legislator concerning Chechnya, Delimkhanov punched him in the head, triggering a struggle during which he accidentally dropped a gold-plated pistol.

Throughout the 2000s, he served in Chechnya’s interior ministry, eventually rising to the position of the republic’s first deputy prime minister in charge of security issues. In 2007, he secured a seat in the State Duma, the lower house of the Russian parliament.

Russian media has linked Delimkhanov to multiple killings of Kadyrov’s adversaries, although he has never faced murder charges in Russia. In 2009, Dubai authorities accused him of murdering a former Chechen general, resulting in Delimkhanov being on Interpol’s wanted list for several years. He has consistently denied all these allegations.

In 2014, the United States imposed sanctions on Delimkhanov for his ties to the Brothers’ Circle, a regional organized criminal group.

Collecting a Debt

The initial instance of Pavel Krotov seemingly acting on behalf of Adam Delimkhanov dates back to 2010.

Filaret Galchev, the billionaire owner of Eurocement Group, Russia’s largest cement producer, faced a challenging situation. In 2007, Galchev had acquired a partner’s minority share in the business for $1 billion, agreeing to pay annual installments of $200 million. However, after making the first two payments on time, he missed the third. Galchev’s former partner initiated legal proceedings, then, growing impatient, sold the remaining debt at a discount. Pavel Krotov, a businessman registered at the time only as the CEO or co-owner of smaller companies with no significant assets, acquired the right to demand payment from Galchev for the remaining sum of $600 million.

Upon Krotov’s involvement, Galchev found a way to promptly settle his debt.

During that period, Russian business media, citing unnamed sources, reported that Krotov acted as a representative of Delimkhanov, with limited additional details. New evidence obtained by The Project now corroborates these earlier reports, linking Krotov to Russia’s most influential Chechens.

“A Few False Entrances”

Four individuals with business ties to Krotov have affirmed to reporters that he acted as a representative of Delimkhanov. However, due to safety concerns, none of these individuals allowed reporters to disclose their names.

Security consultant Alexei Shlyapuzhnikov from Transparency International and a member of OCCRP’s technology team examined the emails used in the story. They indicated that the emails appeared to be authentic, although their digital signatures were either missing or outdated, preventing definitive confirmation of their origin.

Thousands of private emails sent and received by Krotov were obtained by reporters, showing that his correspondents understood him to be working on behalf of Delimkhanov. These emails also revealed Krotov’s connections to Kadyrov. In the late 2000s, he played a role in managing the construction of the politician’s residence. Correspondence discussed various details, including the building’s budget, design, and security features.

In one email, Krotov receives recommendations from a contractor on securing Kadyrov’s compound, suggesting the placement of the bunker beyond the building’s perimeter and connecting it with underground passages. The email attachment reads, “it is better to bring the bunker out beyond the perimeter of the building and connect them with underground passages. Ideally, none of the staff should know where the entrance to the bunker is located. Maybe it’s worth organizing a few false entrances.” It continues, addressing safety concerns about placing the President’s apartments above administrative spaces.

One individual involved in the construction work also confirmed to reporters that Krotov was “working for Delimkhanov.”

Nginx ‘commissioned’ from Group-IB

Rucriminal continues to reveal how a criminal case was fabricated to attempt to take away Nginx from its creators, Igor Sysoev and Maxim Konovalov. According to documents obtained by Rucriminal, the private company Group-IB was responsible for all the technical work required for the investigators of the Main Investigative Directorate of the Ministry of Internal Affairs in Moscow. The top manager of Group-IB, Nikita Kislitsyn, was recently summoned for questioning in the United States in a criminal case involving electronic device fraud. The FBI believes that Kislitsyn was a partner of Evgeny Nikulin, who is accused of hacking into American technology companies and stealing personal data from over 100 million people. Not surprisingly, Kislitsyn refused to travel to the United States and may soon be declared wanted. It is precisely because of the knowledge of Group-IB employees, in which the FBI is interested, that this company was involved in the operation to “attack” Nginx, led by Maximilian Grishin, Vladimir Timoshin, and Kenes Rakishev.

Kenes Rakishev is a Kazakh oligarch who invests funds worldwide for the top echelons of Kazakhstan, primarily for his senior comrade Timur Kulibayev, the son-in-law of former Kazakh President Nursultan Nazarbayev. Western companies and banks wishing to maintain a good reputation categorically refuse to cooperate with Rakishev, believing that the funds he invests have a “dirty” origin. As a result, the oligarch has to engage in raiding. Especially when it comes to a lucrative target like Nginx, a Russian development known worldwide and rapidly increasing in value. Documents in our possession indicate that it was Rakishev who initiated the criminal case, the defendants of which are the creators of Nginx. Following the entire operation, Rakishev was promised that he would obtain Nginx.

Maximilian Grishin and Vladimir Timoshin are dubious Moscow lawyers associated with the Ukrainian law firm “Ilyashev and Partners” and have long been under the control of Russian special services. In 2011, Maximilian Grishin positioned himself as one of the leaders of the white-ribbon movement and was an active participant in events on Bolotnaya Square. However, after communicating with law enforcement, he unexpectedly dropped out of the list of defendants in the “Bolotnaya case.” Moreover, he began a rapid legal career and found himself under the “wing” of his senior comrade, Vladimir Timoshin.

According to Rucriminal sources, Timoshin’s “success” began in the late 2000s after his involvement in a raiding attack on the large enterprise “Krasny Proletariy.” During the capture of the enterprise, its leader and owner Yuri Ivanovich Kirillov was beaten to death in Cyprus in November 2009.

Vladimir Timoshin, thanks to certain very personal relationships, opens doors to many offices in the Main Investigative Directorate of the Ministry of Internal Affairs in Moscow. It was he who negotiated the initiation of the case necessary for the seizure of Nginx. Since there were no grounds for initiating the case, it was decided to “fabricate” it. Last summer, Timoshin began to fabricate the necessary materials. At the direction of Timoshin, Maximilian Grishin compiled fictitious surveys of former Rambler employees, etc. Lawyers also involved Group-IB in their work. Its employees worked with the server, which contained all the internal correspondence of Rambler over the years, and the “specialists” of Group-IB organized access to the personal mailboxes of Nginx creators Igor Sysoev and Maxim Konovalov. In particular, Group-IB managed to gain access to the correspondence between Sysoev and Konovalov with representatives of PwC, IDelyne Group, Greycroft LL.C., Greyeroft Partners II LP., BV Capital VCC, Greenberg, Whitcombe & Takeuchi LLP., Runa Capital I. LP, GlobTechFund. All this work was generously financed by Kenes Rakishev.

Having obtained all this correspondence, Group-IB, under the dictation of Timoshin and Grishin, performed an analysis of “evidence” in which Igor Sysoev, Maxim Konovalov, and their partners were identified as “alleged criminals.” As a result, this product of Group-IB and Rakishev’s lawyers also became one of the materials necessary for initiating the case ordered by Timoshin in the Main Investigative Directorate of the Ministry of Internal Affairs in Moscow. What concerns are troubling Kenes Rakishev?

While the ongoing ‘antiterrorist’ operation continues in Kazakhstan, life in the country is slowly returning to normalcy. However, it remains far from complete equilibrium, hinting at potential surprises. This is evident from an unexpected statement by BTA Bank JSC.

Recalling that BTA Bank relinquished its banking licenses in 2015, it has since operated more like a phantom entity. It exists primarily because the Library and Akorda still wield it as the primary tool in their perpetual ‘war’ against their political adversary, Mukhtar Ablyazov.

Quoting from a press release on the BTA Bank website dated January 19, 2022, and subsequently echoed by certain media outlets (text in bold by KZ.expert):

“BTA Bank JSC informs that it is continuing to work on recovering stolen assets. Following the tragic events at the start of this January and with international judicial trials entering an active stage, the company’s management and shareholder have faced hacker and information attacks. We anticipate potential leaks of false and provocative information. These attacks aim to blackmail and discredit BTA Bank JSC. Ablyazov M.K. and his accomplices are the main figures in these trials.

We urge you not to succumb to leaks of false information and to trust only official sources. Reliable information can be obtained on the official website of BTA Bank JSC www.bta.kz. Let us remind you that spreading deliberately false information is criminally liable according to Article 274 ‘Spreading Deliberately False Information’ of the Kazakh Criminal Code.

We do not know the nature of the information that former Chairman of the BTA Board of Directors Mukhtar Ablyazov and his allies (aka accomplices) are planning to ‘leak.’ However, judging by the concern of the former bank’s ghost, its current owner, Kenes Rakishev, appears more than worried.

At KZ.expert, we believe these concerns are well-founded because, unlike the Kazakh state and the ‘leader of the nation,’ Kenes Rakishev is merely a businessman, albeit a wealthy and influential one.

It is possible that Mr. Ablyazov, for instance, has decided to reveal the story of how billionaire Timur Kulibayev, with direct support from his father-in-law, then-Prime Minister Karim Masimov, ex-chair of Samruk-Kazyna JSC and the National Bank Kayrat Kelimbetov, ex-chair of the RK Agency for Regulation and Monitoring Financial Market Elena Bakhmutova, and associates, stole two BTA Bank assets – one in Russia and another in Kazakhstan. Notably, BTA Bank JSC had invested no less than US$1.3 billion in these assets.

Another sensitive topic for BTA Bank and Kenes Rakishev might be the expenses incurred in the ‘war’ against Muktar Ablyazov. Historical practices suggest that, in such cases, Akorda (now the Library) has not hesitated to fund legally dubious operations, involving not only private detective agencies but also semi-criminal organizations.

Given Ablyazov’s claims of constant surveillance in his social media posts, it is conceivable that he may have uncovered information damaging to Kenes Rakishev’s reputation.

A third topic that could harm not only Kenes Rakishev but also his father-in-law, Imangali Tasmagambetov, is the revelation of the true size of their family fortune and its sources. According to our estimates, the fortune amounts to much more than a billion dollars, and we are prepared to substantiate our estimations with corresponding documents.

Therefore, it is likely that we will soon find information on the internet regarding how and from where Imangali Tasmagambetov obtained hundreds of millions of US dollars that he then entrusted to his son-in-law.

In conclusion, we emphasize that, in this particular case, trusting the official source, i.e., BTA Bank JSC, would be a significant mistake. This is because the said phantom legal entity, whether deliberately or out of laziness, is already deceiving the Kazakh citizens.

Kenes Rakishev – How to Make Everyone Believe in Your Heterosexuality

If you search the web for “Kenes Rakishev”, you’ll inevitably come across information claiming that Rakishev once corresponded with Petr Listerman regarding the importation of underage models into Kazakhstan for various carnal pleasures. But why promote?

There was even information suggesting that representatives of PR agencies themselves post details about Rakishev’s escapades on various informational websites. But why would Rakishev pay for such exposure?

There could be various theories, but among them, one seems quite plausible — for some reason, he actively seeks to showcase his heterosexuality. He literally advertises his love for the opposite gender. During business meetings, he often agrees to visits to saunas and other places where women of a certain lifestyle frequent.

We worked with this idea for a while and couldn’t find a clear answer or explanation until we began closely comparing the life of the London dandy and metrosexual Kenes Rakishev.

The key revelation in exposing Rakishev was his education – according to publicly available information, Kenes Rakishev studied in London. Gay! Kazakhs in Soho!

We managed to find out that the favorite hangout spots for students from gay-friendly faculties were precisely the elite areas of Soho. Gay clubs in Soho were one of the most beloved places for Kenes Rakishev, who still often talks about how cool he parties in London, but without specifying that these are establishments mainly for people with non-traditional orientations.

The United States is investigating the involvement of Kenes Rakishev in the tip of Kazakhstan

Continuing to assert that the business triumphs of Kazakh oligarch Kenes Rakishev are mere illusions, carefully crafted through the sponsorship of numerous media articles portraying him as a successful investor and financial prodigy from Kazakhstan. The primary target audience for this narrative is the upper echelon of Kazakhstan, especially the close associates of President Nursultan Nazarbayev, particularly Timur Kulibayev, whose funds are purportedly managed by Rakishev. The challenge lies in Rakishev’s reluctance to disclose to these influential individuals that their substantial capital may have been recklessly squandered.

In the initial publication, we initiated the expose on Rakishev’s principal “soap bubble” – the Net Element company. Despite being marketed as a lucrative investment, Rakishev’s acquisition turned out to be a dubious project led by shadowy figures, Francesco Piovanetti and Mike Zoe. At the time of purchase, Net Element was a conglomerate of various internet resources, including a website associated with actor James Caan from “The Godfather” and a music service featuring content by composer Igor Krutoy. In an attempt to justify himself to genuine investors, Rakishev started acquiring other projects, all of which proved to be as dubious as Net Element itself. As revealed in the second publication, the company suffered losses, and its stock value plummeted on the stock exchange. To mitigate the actual dismal state of affairs, Rakishev resorted to paid media articles and loud pronouncements about subsequent successful acquisitions.

The most significant scandal unfolded when Kenes Rakishev decided to involve Murray Huberfeld, former Governor of New Mexico Bill Richardson, and Platinum Investment Director Mark Nordlicht in Net Element’s activities and collaborate with the funds of Kazakhstan’s elite, including Timur Kulibayev, the founder of Platinum Partners.

According to Rucriminal, Rakishev personally facilitated visas for Huberfeld and Nordlicht. In February 2013, they were set to fly on a private jet to Kazakhstan, accompanied by former Governor Bill Richardson, who had just become the Chairman of a company responsible for electric vehicle charging, with the support of Huberfeld and Rakishev. However, at the last minute, Huberfeld expressed regrets about missing the trip, stating,

“Dear brother, I’m sorry I won’t be able to take part in the trip. Good luck in the next two days and thank you for all your preparations.”

After a promotional visit to Kazakhstan, an email dated March 4 conveyed gratitude for the meeting at the highest level in the capital, where Richardson and Platinum leaders had lunch with Rakishev and Timur Kulibayev, the son-in-law of Nursultan Nazarbayev.

The most intriguing revelations from the hacked emails of Net Element Chairman Kenes Rakishev detail his association with the hedge fund, Platinum Partners. The correspondence suggests that Huberfeld invested in Israeli technology companies, a fact Rakishev publicly boasted about. Rakishev even attempted to involve Platinum in creating a hedge fund for wealthy compatriots within Nazarbayev’s circle. Rakishev received a congratulatory letter from Huberfeld when Net Element went public on Nasdaq in October 2012. Three months later, they met to plan a Platinum Fund for investors in former Soviet republics like Kazakhstan. In the hacked correspondence, Huberfeld expressed anticipation of a long and successful relationship with Rakishev, excited about the possibilities.

Subsequently, global headlines reported Platinum Partners’ failure, Huberfeld’s arrest on bribery charges, and Nordlicht’s accusations related to attempted fraud amounting to billions of dollars by Platinum. Rakishev swiftly attempted to distance himself, claiming no involvement in any transactions with Platinum. However, the hacked correspondence suggests otherwise. The ongoing investigation into Huberfeld could potentially draw attention to his connections with Rakishev and Kulibayev.

DEJAVU for Kenes Rakishev

We continue to debunk the fake news about the “successful venture investor” Kenes Rakishev. In reality, he is the treasurer for Nursultan Nazarbayev, his son-in-law Timur Kulibaev, and certain members of Kazakhstan’s upper echelon. Rakishev attempts to place their money in various parts of the world. Serious international structures are cautious about these funds, often preferring not to deal with Rakishev. Other companies avoid associating with him because most of his projects end in failure. Business setbacks are often compensated for with paid articles in various media outlets, portraying him as a “successful” entrepreneur.

Recently, Rucriminal revealed one such failed project of Rakishev – Net Element. The company’s stock price dropped from $1000 to $10, accumulating losses in the hundreds of millions of dollars.

The situation is even worse in Rakishev’s joint projects with Israeli businessman Moshe Hogeg. Articles about their joint company, SIRIN LABS, its blockchain smartphone Finney, and its issued digital currency flooded the internet, creating an impression of a unique product similar to the iPhone.

However, the results were disastrous. Finney sales were minimal, and the value of SRN, the company’s issued digital currency, dropped by 99% since its peak in January 2018. In spring 2019, SIRIN LABS delayed salaries for its employees by 2-3 months and then reduced them by 25%. The company stated, “The company is outsourcing part of its work and plans to focus on software development and distribution – sales are not as expected.”

In spring, Canadian internet entrepreneur Adam Perzov filed a $50 million lawsuit against Rakishev, his partners Moshe Hogeg, and Joseph Chen in California. Perzov claims that Hogeg and Rakishev breached a joint venture agreement, where he was promised to be a partner and manager in a company that would use the domain invest[.]com.

The lawsuit also alleges that Hogeg and Rakishev participated in a conspiracy involving at least 16 individuals and companies. The lawsuit accuses Hogeg and Rakishev of deceiving many investors worldwide out of hundreds of millions of dollars. Perzov claims that Hogeg and Rakishev violated the RICO Act, a U.S. federal law designed to combat organized crime in the United States. The lawsuit includes six points: breach of contract, breach of loyalty duty, impossibility of proper payment, fraud, violation of business registration law, and violation of the RICO law.

However, it’s not surprising. In paid articles, Rakishev and Hogeg successfully invest investors’ funds day and night. However, according to leaked correspondence, Hogeg and Rakishev were involved in other activities – “gifting” each other girls from modeling agencies. For example, in February 2013, Moshe and Kenes arranged a meeting in New York, where Hogeg sent Rakishev an email with the subject: “Choose!” containing a link to the models’ portfolio on the DEJAVU MANAGEMENT agency website.

In another email that Hogeg sent to Kenes, there is a video. Captured beauties express various forms of interest and invite Rakishev to join them in Israel.

Kenes warmly thanks his partner and promises to visit soon, praising the “special” Kazakh beauties he will bring with him. In the correspondence, Rakishev receives photos from Hogeg of a girl named Daniela, flaunting a Dior watch – a gift from Kenes. The gift cost the Kazakh businessman quite a sum.

Kazakhstan: Rakishev’s BTA Bank Appears in Cohen Hearing

Kazakhstan unexpectedly became a focal point during a day of testimony by Michael Cohen, President Donald Trump’s former personal lawyer, before a U.S. congressional committee on February 27.

Cohen, who awaits a three-year prison term after pleading guilty to criminal acts while working for Trump and lying to Congress, disclosed that he had been hired by Kazakhstan’s BTA Bank to assist in recovering money allegedly laundered in the United States.

Republicans on the committee used this revelation to question Cohen’s credibility, arguing that he failed to disclose these contracts with foreign entities while completing committee forms.

Mark Meadows, a Republican representative from North Carolina, confronted Cohen about the lack of disclosure, specifically asking about money from BTA Bank. Cohen confirmed, stating, “I did.”

Cohen explained, “The former CEO of that bank had absconded with between $4 [billion] to $6 billion, and some of that money was here in the United States, and they sought my assistance in terms of finding, locating that money, and helping them to recollect it.”

BTA Bank, once the largest bank in Kazakhstan, faced financial difficulties under the leadership of opposition figure Mukhtar Ablyazov, who later fled in 2009. Since then, Kazakhstan has made significant efforts to extradite Ablyazov and recover the alleged $4 billion embezzled by him.

This incident is not the only connection between Ablyazov and Trump’s business interests. In January, Bloomberg reported that Ilyas Khrapunov, son of former Almaty mayor Viktor Khrapunov, attempted to conceal emails detailing efforts to buy condos at the Trump SoHo tower in Manhattan as part of a money-laundering scheme. BTA claims Viktor Khrapunov was an associate of Ablyazov.

BTA’s lawyer, Matthew Schwartz, stated, “Michael Cohen was recommended to BTA Bank in 2017 as a person who had access to the best legal resources and was hired by BTA to assemble a winning team.” Cohen received $300,000 before the bank suspended their agreement. Schwartz claimed Cohen provided no value, and the bank fully cooperated with investigations into Cohen’s activities.

As Kenes Rakishev have “dropped out” of the “business Shakro”

Rucriminal has obtained transcripts of court proceedings in two criminal cases: one involving the “thief in law” Zachary Kalashov (Shakro Young) and another concerning OVD Presnensky employees who did not intervene during an incident at the “Elements” restaurant. We will highlight the most noteworthy segments of these hearings. The initial focus will be on the testimonies of attorney Edward Budantsev and the victim Gannim Kim, the owner of “Elements,” a target of alleged extortion orchestrated by Shakro and his associates.

Kim, a citizen of Kazakhstan, declined to fly to answer questions from the accused lawyers, mainly to avoid inquiries about her patron, Kazakh oligarch Kenes Rakishev, who played a substantial role in the incident. Rakishev dispatched his lawyer, Eduard Budantsev, and armed personnel to assist Kim, leading to a confrontation with Shakro’s group, led by “authority” Andrey Kochanova (Italian), resulting in a shootout.

Budantsev’s first interrogation occurred on December 16, 2015, while he was still in custody (later under house arrest). He detailed the events of December 14, 2015, when Kim urgently called him for assistance at “Elements.” Budantsev initially thought the caller was Vyacheslav or Kenes, but it turned out to be Kenes Rakishev. Phone records revealed connections between Budantsev, Kim, and Rakishev, indicating coordination. However, Kim, unaware of Rakishev’s involvement, recorded conversations with extortionists.

Notably, after learning about Rakishev’s intervention, Kim’s behavior changed significantly. A police officer, Shakirov, described Kim’s provocative actions, consciously recording conversations to elicit specific responses and encouraging aggressive behavior.

Later, Budantsev altered his testimony, downplaying Rakishev’s role, citing a legal assistance agreement with Kim’s company since 2014. Kim adhered to these revised testimonies, contradicting initial statements and tape transcripts.

During the trial of Kalashov and Kochuikov, Kim, testifying via video conferencing in Almaty, faced threats from Shakro. If she slandered them, Shakro threatened to expose her investors, including a relative and the person who sent Budantsev—indicating Rakishev.

As a result, Kim refused to answer questions, avoiding potential revelations about Rakishev’s involvement, effectively dissociating the Kazakh oligarch from the “Shakro case.”

Rucriminal now delves into Kim’s detailed testimony during the hearings, providing insights into the extortion she experienced.

Kim reported that she met Misikova in March 2014 and signed a contract later that year for design and repair work at the “Koba” bar and “Elements” restaurant in Moscow. Despite giving Misikova 33 million rubles in cash, Misikova failed to fulfill her obligations, leading to a conflict. Misikova baselessly demanded the transfer of 8 million rubles.

Around December 9 or 10, 2015, three unknown individuals accompanied Kim, demanding the resolution of a debt issue with Fatima. Kim, denying any debt, received threatening calls, demanding a resolution. A lawyer issued an ultimatum for an immediate meeting on December 13, threatening consequences if they failed to comply.

On December 13, the lawyer called again, suggesting a meeting at the restaurant on Presnenskaya embankment in Moscow. On December 14, around 19:00, Kim was at “Elements” when five aggressive men entered, accompanied by a group outside. Fearing consequences, Kim called the police and sought help from Budantsev.

Despite police arrival, the situation escalated, with demands for the transfer of 8 million rubles persisting. Kochuikov later arrived with armed guards, declaring his affiliation with “thief in law” Shakro Young. A confrontation ensued, leading to a fight and shootout provoked by Romanov, Kochanova, and their group.
